Purpose

This transition policy provides guidance relating to training related expenses approved or incurred prior to the October 1, 2013 implementation of the amendments to the Veterans Well-being Regulations (VWR).

Policy

Background

  1. On October 1, 2013 amendments to the Veterans Well-being Regulations introduced a global maximum amount for training related expenses that may be approved in an Individualized Vocational Rehabilitation Plan (IVRP).
  2. This transition policy should be read in conjunction with the Vocational Rehabilitation and Vocational Assistance - Training Expenses Policy.

General Policy

  1. Any expenses approved in an IVRP must adhere to the VWR and policy in place at the time that the expense is incurred. An expense is incurred when the service or product is received which creates an obligation to pay.

Expenses Incurred Prior to October 1, 2013, but Claim Submitted after October 1, 2013

  1. In cases where a claim is submitted on or after October 1, 2013 for an expense incurred prior to October 1, 2013, the VWR in force on the date the expense was incurred applies to the expense. Therefore, expenses incurred before October 1, 2013, must adhere to the rates authorized in the VWR that was in place before October 1, 2013.  Expenses incurred on or after October 1, 2013, must adhere to the rates and terms of the VWR that is in place as of October 1, 2013.
  2. For example, prior to October 1, internet fees were capped at $25 per month. Claims submitted that were for internet service fees incurred prior to October 1, 2013 would be payable at a maximum of $25 per month, unless a higher amount had previously been approved under the 15(3) provisions.

Expenses Approved in an IVRP prior to October 1, but Not Incurred before October 1, 2013

  1. IVRPs approved prior to October 1, 2013, may be revised following that date to ensure that all needed training costs may be reimbursed to the fullest extent possible. For example, when an IVRP was developed in September 2012, $25 per month for internet fees was approved for a two-year training program. Beginning October 1, 2013 the cap on internet fees has been lifted and therefore the participant may be eligible for a higher amount from that day forward. IVRPs may be considered for revision at the request of the participant.

Review of Decisions

  1. A first or second level review of a decision, whether on application by the participant or on the Minister’s Own Motion, must apply the policy that was in place at the time the decision under review was made.
